Currently, Ebay is able to avoid liability for fraud that occurs on its site through its disclaimer statements. Ebay acts as a third party in transactions, including fraudulant ones. Since Ebay recieves a percentage of the sale, in addition to listing fees, it should be held to some degree of liability. I believe that legislation that would require Ebay to do more to prevent fraud and offer more protection to buyers and sellers would significantly lower the amount of online auction fraud. It seems that without the threat of financial liability, Ebay only maintains the minimum requirements, since its revenues are directly linked to the commission and fees. I also believe the additional costs that Ebay would have to incur would be recovered by the increase in sales due to increase consumer confidence. What impact to you beleive legislation would have on the amount of fraud that occurs on Ebay?
