Posted at July 15, 2005, 12:33 pm: I am looking for assistancce on the following matter: I recently placed a Hermes scarf up for auction. About 5 days after the close of the auction, I received a notice that Hermes had initiated a Vero claim against me. I am frustrated in that I know that the scarf is not counterfeit. I purchased it at a Hermes store approximately 14 years ago. After researching the matter, I learned that Digital Detectives is the agent for Hermes. As per E-Bay directions, I contacted Digital Detectives and Hermes. Digital Detectives insists that the scarf is counterfeit. Hermes refuses to talk with me, saying that I must talk with E-Bay. I researched both Digital Detectives and Hermes on the internet, using resources such as Hoovers, EDGAR and the US Court of Appeals (as Hermes was the plaintiff in a major case in the 2nd circuit). I cannot find any information on Digital Detectives. And, it is not possible to reach Hermes Legal Department. I offered to send the scarf to Hermes, assuming that they pay the shipping, to show that it is not a counterfeit. As a result of their action, I lost the sale. Digital Detective refuses to tell me on what basis they made their decision. I filed a counterclaim with E-Bay, but, from I understand, E-Bay is not helpful. They take the word of the vendor. I want to file a lawsuit against Hermes and Digital Detective. However, since Hermes is based in France and I can find no information about Digital Detectives, including the state or country in which they are located, I am at a loss of how to pursue them. Also, I do not wish to spend the money for an attorney, as the cost of an attorney will exceed the amount of the sale. I need the money badly for financial reasons. Where do I go from here? I feel that the Vero rights program is a violation of my due process rights. However, I do not know where to go from here. I thought about starting an internet based campaign, gathering people who have been wrongly accused by Digital Detectives and Hermes. Does anyone know of the forum in which I can start this campaign?
