I am not a power seller, so I had never heard of VeRO before this morning. I listed a used set of Kaplan LSAT Course books on eBay last Saturday. This morning, I received the VeRO form letter from eBay indicating that my listing had been terminated at the request of Kaplan. I contacted them and received a response indicating that "non-retail
items such as student kits (items sold concurrently with courses)..." may not be resold, presumably due to copyright infringement.

My somewhat limited understanding of copyright law is that I have the legal right to resell this under the doctrine of first-sale. Has anyone else had experience with Kaplan or other similar organization that provides books or other course materials as part of the course? Does the fact that these books are only made available as part of the course and are not sold separately supersede the first-sale principle?
