As most of you probably know, the United States Congress passed an internet gambling bill. Some sites have reacted drastically in the immediate aftermath of the news. Below is a detailed analysis/statements of where these sites stand. We will try to keep you updated as we hear about developments. Please let me know if there are any errors in this post- things can change fairly quickly.

Crypto: Sites are sending out checks to closed American accounts.
iPoker Playtech, the software provider, annouced on October 6th, that they will no longer allow sites using their software to accept Americans.
Ongame/Poker Network: Some of the comments from individual sites seem positive, however, from Ongame they seem to be taking a wait and see approach. It is unclear at this time whether they would require the entire network to not accept Americans or just specific sites. They are publically traded, which is a concern.

On Friday 29 September 2006, the US Congress passed legislation which includes certain provisions to prohibit internet gambling through the restriction of payments to such sites. We are currently analyzing the potential effects of the legislation.

The Bill states that there will be a period of up to 9 months for the US regulators to prescribe regulations requiring each designated payment system and all participants therein to identify and block or otherwise prevent or prohibit restricted transactions. Until, we have further clarity on these regulations and how it is proposed they will be implemented - it's a little hard to say what the final impact will be.

The vast majority of all deposits processed by our company are processed through non US payment processors. It is currently unclear how these payment processors, based outside the United States, with no assets, presence or employees in the US, would be affected by this bill.

Once the regulations have been written, we will have a clearer view of which companies are affected, how those companies will be expected to comply, and any possible resulting impact on our customers based in the United States.

Regarding the recent bill passed regulating payments to online gaming sites-

Most important is that this bill does NOT make it illegal for individuals to play poker online.

The bill targets payment processors and US banks and is basically trying to make it difficult for online poker sites to allow their customers to fund their accounts (nothing new here really).

The bill does not take effect immediately. After the president signs the bill into law (if) (within the next 7-10 days), a government board will have 270 days to come up with new regulations for the banks and payment processors to follow. And even after the regulations are published they will likely not go into effect immediately, since the banks and payment processors will need time to add systems to comply with the new regulations. Smaller banks have already stated they would not even have the necessary resources in place to monitor such transactions.

We want you to know that we will continue doing business with our US customers. We are a legal and licensed business in the Netherlands Antilles and none of our operations are carried out on US soil. We have no intention of closing USA player accounts or restricting their ability to play on BugsysClub.

The World Trade Organization ruling brought by Antigua and Barbuda has repeatedly instructed the United States to stop trying to block US residents from playing at such operations while the US simultaneously favors certain US operations (such as horse betting, lottery etc).

I will personally update you with any updates to this situation if or when they occur.

Thank you for your email. Let me start by saying that CakePoker definitely does not intend to restrict access to our valued players from the United States. It appears that some of our competitors have decided to take this preemptive step for business reasons that are most likely related to the fact that they are publicly listed companies. In other words, they cannot be seen as doing anything that would put their shareholders in a precarious position. CakePoker N.V. is a legally licensed and privately held company in the country of Curacao. We have no such pressures placed upon us.

Further, this bill still has some stages to go through and is not likely to even become a law until the spring of 2007. If/when this bill actually becomes the law, our legal department will formulate an official policy on CakePoker accepting payments from US residents via US based financial institutions. However, as an alternative to accepting payments from US based financial institutions we have worked very hard to gain official acceptance as a legitimate business entity by some of the internet's major, non-US based financial institutions such as NETeller and Firepay.

Needless to say there will continue to be a lot of confusion and misinformation spread in the near future as everyone tries to interpret the terms of the bill as best they can.

Therefore our official position is that the passing of this bill does not currently affect us or our valued, loyal players in any way. As I stated earlier if/when the bill passes we may just have to limit some of the ways we accept payments from US players.

Internet gaming company 888 Holdings PLC confirmed it has indefinitely suspended business from US customers, following a move by US congress to outlaw online gambling.

888 issued a statement after the US congress unexpectedly passed a bill at the weekend which will make unlawful the receipt by a gambling business of proceeds or monies in connection with unlawful internet gambling.

The legislation is expected to be signed into law by President Bush within the next two weeks, and will become effective immediately thereafter.

The Act requires the Secretary of Treasury, within 270 days, to issue regulations requiring financial institutions to block transactions in connection with internet gaming.

Unfortunately, on Friday October 13th President Bush is expected to sign into law the Unlawful Internet Gambling Enforcement Act of 2006. The legislation is designed to restrict Americans from being able to fund their online poker accounts and in doing so to prevent Americans from participating in one of their national past times. Paradise Poker, as part of the SportingBet PLC group of companies, is publicly traded on the London Stock Exchange and is obligated to act in accordance with the new legislation. After much deliberation, our Legal Team has advised that in order to comply with the new legislation Paradise Poker will be required to stop accepting deposits from all US players. In addition we will no longer be able to offer US players the ability to transfer funds to each other using the ‘Send Money To Player’ function or to transfer funds to Sportsbook.com.

Please be assured that all US customers will continue to be able to access their accounts and submit cashout requests as normal. Although we will no longer be able to accept additional deposits, players will continue to be able to play at our real money tables with the funds they already have on deposit at Paradise until November 13th 2006. On 30 September 2006, the United States Congress passed The Safe Port Act. That measure also contained certain provisions known as the ‘Unlawful Internet Gambling Enforcement Act of 2006’ that will affect the processing of payments between US customers and online gaming companies, including PartyGaming, that are publicly traded and licensed and regulated in respected jurisdictions.



The Act is expected to be signed into law by President Bush within the next two weeks. If signed into law, it will immediately make unlawful the receipt by a gambling business of proceeds or monies in connection with unlawful internet gambling. The Act does not clarify the definition of unlawful gambling. However, as the first piece of Federal legislation dealing explicitly with internet gaming, it does make clear that the US government intends to stop the flow of funds from Americans to online gaming operators through criminal sanction. The Act also asserts that, under US law, a wager must be permitted under the laws both of the customer’s place of residence and that of the operator.



After taking extensive legal advice, the Board of PartyGaming Plc has concluded that the new legislation, if signed into law, will make it practically impossible to provide US residents with access to its real money poker and other real money gaming sites. As a result of this development, the Board of PartyGaming has determined that if the President signs the Act into law, the Company will suspend all real money gaming business with US residents, and such suspension will continue indefinitely, subject to clarification of the interpretation and enforcement of US law and the impact on financial institutions of this and other related legislation. Access to PartyGaming's online gaming sites for the Group's US free play customers will be unaffected. Access for all of PartyGaming’s non-US customers will also be unaffected.



The Group’s strategic focus remains on developing its existing markets outside of the US and on developing new markets and products. Should activities in the US be suspended, the Directors will also seek to re-align the Group's cost base to accommodate the changed business environment. However, any such suspension would also result in the Group’s financial performance falling significantly short of consensus forecasts for 2006 and 2007.



Mitch Garber, Chief Executive Officer of PartyGaming, said:



"This development is a significant setback for our company, our shareholders, our players and our industry. While US horse race betting, state lotteries, fantasy contests and certain other online gaming activities have been exclusively protected under the new law, we are disappointed that the popularity and skill of poker in particular have not also been specifically protected. The Board respects the laws of the US Government, and will continue to analyse their applicability, but also continues to believe that a regulatory framework for online gaming, including poker and casino gaming is the only sustainable long term solution.



"We have a substantial gaming business outside the US, one that is highly profitable and growing rapidly on one of the most technologically advanced platforms available. In the first half of 2006 our non-US business generated revenues of $150 million, a 151% increase over the comparable period in the previous year. Gaming on the internet is already a popular form of entertainment for millions of adults and we will continue to expand our business into new territories, offering fun, responsible and friendly competition in a safe and secure environment for customers around the world.
